۹۱ : ـ هرگاه یک منصبدار مافوق در حق ماتحت خود، بلا سبب
معقول امر ضرب بدهد، و یا آن امر ضرب را بالذات
بدست خود اجرا نماید [ از دو ماه تا یکسال حبس ]
و هرگاه ضرب مادون برای مدافعه مشروعه عن النفس
و یا مدافعه مشروعه عن الغیر، و یا سد و جلوگیری فرار
و یا تسکین تاراج و یغما بعمل آید، مافوق از جزا قطعاً
معاف است .
