۳۸ ممیز مقرر کند که بالای زمین های افت رسیده و سوخته رفته علم آوری شد نمایند - و علم آوری مذکور به تفریق بالا (اول) زمین ها و باغاتیکه کاملاً ضرر رسیده باشد . (دوم) اینکه مناصفه را ضرر و باقی آن سالم باشد .
