الحاكم يقال للطالب مدعى والمطلوب منه مدعى عليه ـ
( ٢ ) المدعى هو الشيء الذي ادعاء المدعى ويقال له المدعى به ايضا
( ٣ ) التناقض هو سبق كلام من المدعى مناقض لدعواه يعنى
سبق كلام موجب لبطلان دعواه
